Minnesota stoners might want to think twice about puffing their herb through water pipes as the Minnesota Supreme Court ruled in a 4-3 decision on Thursday that bong water is “a preparation, compound, mixture, or substance containing a controlled substance, regardless of purity.”
While the substance that people tend to smoke in bongs is in itself a controlled substance, the bong water decision has the potential to turn a misdemeanor possession charge into a felony, because the weight of the water is taken into consideration.
Prior to last Thursday, bong water was treated as paraphernalia, now it is treated as a drug, and can be weighed at the time of the arrest. Twenty-five grams is the tipping point between a misdemeanor and a felony and liquids are a good deal heavier than dried vegetative matter. Given that water weighs in at one gram per milliliter, just one shot glass full could result in a first-degree drug conviction and a lengthy custodial sentence.
