Brothers Jailed For Fighting Off Knife-wielding Attackers Who Tied Up Family

A millionaire businessman who defended himself against a knife-wielding burglar was sentenced to two-and-a-half years after his attacker walked free.

According to the Daily Mail, the attack occurred during Ramadan. When 53-year-old Munir Hussain and his family returned from the mosque, they found themselves confronted by the three masked men. One of Hussain’s son’s managed to escape and alert Munir’s brother, Tokeer, who lived just two houses away. Meanwhile, Hussain, his wife, 18-year-old daughter, and other son were tied up and told to lie down on the floor if they wanted to live. Hussain broke free, threw a coffee table at his attackers and then retrieved a cricket bat and metal pole.

Munir and his 35-year-old brother chased the gang out of the house and caught up with one of the burglars, 56-year-old career criminal Waled Salem. The pair then subjected Salem to a severe beating while he lay on the ground using the aforementioned cricket bat, metal pole and a hockey stick. Salem was left with skull fractures and brain damage.

In sentencing, Judge John Reddihough stated:

The prosecution rightly made it plain that there was no allegation against you, Munir Hussain, in respect of the force you used against Salem in defending your own home and family or of the force used by either of you in apprehending Salem.

However, the attack which then occurred was totally unnecessary and amounted to a very violent revenge attack on a defenseless man.

It may be that some members of the public or media commentators will assert that Salem deserved what happened to him, and that you should not have been prosecuted and need not be punished.

The courts must make it clear that such conduct is criminal and unacceptable.

Munir Hussain was sentenced to 30 months in jail for grievous bodily harm with intent. His brother Tokeer received a 39-month as he was subjected to less provocation.

Ironically, for his part in breaking into the Hussain home, tying up the family and threatening their lives, Salem received a non-custodial sentence.

The Hussain brothers plan to appeal.
